Wills And Estates

There are many components to an effective estate plan. In addition to providing direction on asset distribution, a comprehensive plan should include incapacity planning and provisions for loved ones with specific care needs. McMurter & Associates has provided individualized advice and planning guidance to Whitby and Durham Region residents for more than 30 years.

Our aim is to “demystify” wills, powers of attorney and trusts, so everyone has access to the knowledge they need to make informed choices about their estate plans. We have been doing this work a long time, but nonetheless remain passionately committed to personal, individualized service for each of our clients.

Our Wills And Estates Services

A comprehensive estate plan in Ontario will generally include:

  • A will, which can specify asset beneficiaries, the estate’s executor and guardianship of minor children. A will maker can also establish a trust to preserve assets for beneficiaries so they do not receive money until certain conditions, such as age, are met.
  • Powers of attorney, which designate specific individuals to make choices about finances and personal care. These will come into effect during a person’s lifetime, under the specific conditions outlined in the power of attorney.

At McMurter & Associates, we start our estate planning consultation by asking you to provide information about your finances, dependants and any particular concerns you would like to address. For example, we can take steps to ensure that a loved one with care needs receives the benefit of an inheritance without losing eligibility for government disability benefits.

In addition to estate planning, we advise estate executors on administration of estates to ensure that they are meeting their legal and ethical obligations.
